Further to Lloyd’s comments about Scottish territory being given to England by the Scottish Parliament in 1999, I disagree that this ‘devolved entity’ had authority to do so. The Scottish Parliament is a creation of Westminster. (It is a pity that so few Scots lawyers and even fewer politicians understand the constitutional status of Scotland.) A devolved Assembly — which Tony Blair likened to a parish council — doesn’t have the authority to take a decision beyond its vires.
On the contrary, the relevant context is the international Treaty of Union (and critically the Articles of Union which set out conditions for the new relationship with England in 1707). Nothing in this Treaty permits Scotland’s territory to be ceded to England by an arrangement ‘internal’ to the governance of the British State. Dissolving the Treaty of Union will confirm the full status of Scotland’s rights including its internationally established territorial rights. Exactly Joan I don’t think Lloyd was stating it was legitimate but that it happened in this manner. I was saying that Blair and Dewar got together to do it. Lloyd was stating the Scottish Executive, which it was at the time, voted to support it. Given that Dewar controlled the Lab/ Lib Majority Government no great surprise. You are of course right the Executive have no powers to divest Scotland of its territory it was completely unconstutional. The key political point however is that it displays conclusively that Scotland never joined a territorial union and therefore the continued plunder of our natural resources is entirely illegal.

Yes, I know that Lloyd was focusing on the method. However I felt it appropriate to highlight the illegitimacy of the action. I’m also mindful of Blair’s cunning. Setting up a John Baliol type of vehicle for his own purposes. But he didn’t reckon for Alex Salmond!

First any territory signed over to the Westminster colonial government, by the Scottish colonial administration whether Labour or anything else is illegal and is a gross deception. It is against the Scottish constitution and the terms and conditions of the treaty of Union and also international law. As pointed out this so called Union was never a territorial Union, contrary to the colonial masters twisted opinion which does not count.

Another enlightening and entertaining Prism, I personally don’t believe Ash Regan or ALBA should support the suppurating corpse that is Useless and the Scum Nonce Party , their deliberate and wilful actions to scupper independence by introducing reviled and divisive policies vehemently objected to by normal right thinking people shows their duplicitous self serving perverted deviant attitude, that combined with the greater threat to our women and children’s safety and security should earn them ridicule and social exclusion
I think Ash Regan and Alex Salmond are being disingenuous to voters by throwing the snp and Useless a lifeline , they need destroyed for the misery they have caused to Scotland and Scots
