Sally’s Letter to the Chief Constable


Sally visited the Police Station as planned and awaits a formal reply to her word and phrase examples. In the meantime she is not just hanging about.

This is the letter retired police officer Sally Hughes has sent to the Chief Constable. It contains many good questions and I hope to publish a reply when she gets, hopefully, a full reply.

Dear Chief Constable,

I’m writing to you out of deep concern with regards the reputational damage to Police Scotland with the imminent roll out of The Hate Crime Bill.

This Bill has been criticised by retired Judges, serving KC’s, Women’s Rights Groups, The Scottish Police Federation and individuals alike, all of whom have highlighted the far-reaching consequences this bill is likely to have on freedom of speech.  Most readily described as Bad Law, written badly, and likely to be impossible to Police fairly without impinging on citizen’s Human Rights.

Much of the concerns appear to have already been argued in Court, in England, at the highest level, resulting in the change to their Policing Guidelines, as produced 20th October 2020 by the College of Policing, stating that Hate Crime Incidents will only be noted by Police if… the complaint presents a real risk of significant harm to individuals with particular characteristic/s and/or REAL risk of future criminal offence may be committed against individuals or groups with a particular characteristic.

As you were a senior serving Police Officer, in England, at the time these principles were argued in court and then implemented into Policing structures, I’m wondering what steps you took, as Chief Constable of Police Scotland, to draw to the attention of the Scottish Government the limitations this current legislation has, the damage it will do to citizens’ maliciously accused, the professional credibility of Scotland’s Police Service, and the legal cost of rectification both at court, and subsequent re-training of Police Officers.

I note with concern, the implementation of Remote Recording stations, for this legislation, including a Sex Shop!  

Can you confirm that the common law offence of making false allegations to Police, will still be investigated fully by Police Scotland, even if, technically the complaint was initially submitted at a Remote Recording Station and not to a Police Officer?  Under Common Law/ unlike statutory, this technicality should not be an issue.

Do you know if these outwith agencies are receiving Government (including local) funding, that would be more efficiently utilised by going to fund the Police in the first instance.  If funding is going to these other agencies, can you clarify if budgets have been drawn up estimating what savings and/or cut backs to the Police are being made in return.

Can you explain, what, if any, risk assessments were made, with regards the likelihood of vulnerable persons attending to report upsetting incidents to staff trained in the fine arts of selling sex aids and pornography, in an environment where customers are cueing up to purchase such items?

Can you confirm, that incidents reported at such places, subsequently found to be invalid, or not meeting the criteria specified, will not be recorded in a 2-tier manner, the first to show a huge increase, the second to close the file.  Or to put it more succinctly – that spurious, vexatious complaints will be recorded as such.

Can you confirm that those accused, will be notified that a complaint has been filed against them, even if no further Police Action is recommended.

Can you confirm the principle of Moorov, will not be extended to include incidents that do not meet the definition of criminality, no matter how hurt the complainer feels.

Can you confirm, that Police Officers investigating these complaints, will have your full support and backing in refusing to implement this bad law, where no crime has been committed, where to do so would be a contravention of the alleged perpetrators Human Rights – that you will not attempt to pressurise officers to follow unlawful orders.

Can you acknowledge, that the lack of biological science-based fact, along with vague legal definitions of what it legally means to be ‘transgender’ make it a faith held belief, and the legal win by Maya Forstater established in law, that gender critical beliefs are protected, and for this reason, Officers from Police Scotland should not be recording non crime instances of disagreement over this issue, any more than they should be recording incidents of atheism. 

Can you confirm this aspect is something you have warned the Scottish Government about and can you re-assure the public by publishing Police Scotland’s official guidance to officers on this matter.

Can you confirm if procedures are in place to measure incidents recorded at remote stations, that fall far short of competency and in effect double the amount of Police time need to re-record them in a proper fashion.  

If the remote recording stations receive Government funding, will Police Scotland be able to re-claim back moneys in such circumstances… similar in effect to mutual aid within the Policing service?  And will Police be reporting such incompetence’s to a central body for review.

I am aware of at least 4 separate organisations/bloggers who are seeking legal advice and/or considering stopping publishing their information as a result of this bad law.  The chilling effect on freedom of speech is very real and now active.

I look forward to your response.  I would appreciate if each point is addressed separately.  I will be making the contents of this letter and your reply public, and sharing it in full with the Scottish Policing Authority and Scottish Police Federation.

    That is an extremely well informed and very well written letter from Sally Hughes.

    Jo Farrell has had a profile lower than a snake’s belly since her appointment as Chief Constable of Police Scotland.

    Her response to the questions posed by Sally Hughes will be very telling indeed.

  2. It will be intersting to see what, if any, detailed responses will be received to the questions about the roll-out of the Hate Crime and Public Order (Scotland) Act 2021. It is, of course, no longer a Bill, as it has been enacted by the Scottish Parliament and given Royal Assent.

    1. The most likely response will be that Police Scotland only carries out what is legally passed by Holyrood and Westminster – it’s not our fault because we have no part in the political process – or something equally ridiculous.

      I am wondering how many police officers in Scotland who recognise bad law when they see it and how impossible the recording and analysing of the data is going to be will feel obliged to follow “the letter of the law” to ensure that they don’t damage their career prospects by speaking out against it?.

      1. No one shall be subjected to arbitrary or unlawful interference with his privacy, family, home or correspondence, nor to unlawful attacks on his honour and reputation. 

      A record of having been responsible for a “hate incident” will certainly be an attack on “his honour and reputation”. However, as this is now part of Scots Law these attacks are now lawful.

      Should Police Scotland fall back on the hate incidents being “confidential”, the complainant obviously knows their accusation has been recorded as such, so how long before that gets into the public domain?

  3. Something tells me that the Police will not answer the questions Sally has asked.

    The Police know bad law, bad process, bad procedure, abusive procedure, potential for trumped up charging when they see it.

    Police Scotland are art and part in support of implementing an utterly flawed system. Not for them a commitment to fair and just policing. Thugs in uniform no different from the infamous Gestapo and other such aberations. And just look how enthusiastically they have embraced the change.

    They make no attempt to conceal their commitment to aiding and abetting abuse of process, and the breach of people rights.

    As an ex police officer Sally has asked some searching questions.

    For me one particular insanity in the whole grim picture was the outsourcing of hate crime reporting to the local sex shop. Honestly you could not make that up. Maybe Police Scotland might extend that to the local brothel. Or what about the local drug consumption rooms.

    Or the local pub or the bookies or even Tesco where every little helps. No police needed. And they say in police websites come forward, we will investigate everything, we want to help!

    But tthat in truth is only one aspect of today’s policing.

    Police Scotland is now an enemy of the people. It has shown itself to be utterly ruthless in the pursuance of partisan political bias.

    Exposed as a political force commited to bad partisan policing I do not expect Sally to receive any worthwhile response to her letter. They know exactly what they do.

  6. Sally Hughes, with this letter enhances her reputation as a potential Independent Independence candidate. She reinforces the opinion that I and my wife formed several years ago at two conferences of her strength of character and absolute commitment to improving the lot of the sovereign people of Scotland.

    Like Duncanio, we await with great interest the response from the Chief Constable to Sally’s letter. It should be very revealing. It ought to be.

  8. I find it very strange that somebody from another country, with a different legal system to Scotland, can be put in charge of police Scotland. Was there no Scottish policeman/woman up to the job?

Alan I have often asked the same question when you see people from other countries not just england who hold positions of power being interviewed on tv , I have also noted the increase in Irish accents on tv, and when the broadcasters are supposedly out on the streets asking the LOCALS what they think about items in the news I ask myself have ALL the Scots locals disappeared or are they conducting the interviews in england or ireland

      It begs the question what are the REAL figures for incomers and why is the extortionate failed Census figures still not being released

      If you look at the cretins infesting HR what percentage of them are indigenous Scots

      As Alf Baird often explains when it comes to ensuring a colonised country remains the PROPERTY of the coloniser it is a no brainer to ensure that the overall management of that colony and the overall power within that colonised country remains by whatever means possible subject to the colonisers whims and allies

      TBQH you only have to look at the political representation Scots have had for the last 300+ years to realise that 99% of them are more brit Scots than they are Scot Brits

    Well since you can make a report anonymously I suspect the “at best” answer to that is “possibly, where we can!”.

    “Can you confirm that those accused, will be notified that a complaint has been filed against them, even if no further Police Action is recommended.”

    They aren’t notified currently and I suspect they won’t be in the future. I also suspect Sally knows this and just wants it on the record!

    It will be interesting what if any response Sally receives.

    Did Farrell swear the Scottish Constable’s oath before taking office?

    If so, how does she square that with the English one, as they would appear to be incompatible.

    Previously the English one referred to the monarch as Sovereign, now it instead refers to faithfully serving the King / Queen in the office of Constable.

    So did she swear a new oath, possibly thereby being forsworn with respect to her prior one, or did she maybe get the monarch to first release her from the English oath before swearing the Scottish one?

    Or is she not actually a Scottish Constable?

JB. Following your points re the Oath, I had a wee look on the Police Scotland website and noticed that within 300 recent appointments “Languages spoken fluently by recruits include Polish, French, Urdu, Gaelic, Greek, Arabic, Dutch, Slovakian, Swedish, German, Italian, Farsi, Spanish, Romanian, Welsh, Afrikaans and BSL.”

      That’s going above and beyond because can anyone tell me how they manage to “fluently” speak BSL? Does no-one proof-read this stuff before posting on their website? Either that or they don’t understand that although British Sign Language is one of 3 languages of Scotland recognised by the Scottish Parliament it is signed and not “spoken”! I thought the name would have been a clue!

A brilliant, concise letter from Sally on this, and it should receive the equal response (we shall see) I listened to Sally at the TASP live event in Perth where she voiced her opinion on this “bad law” Her video outside the police station was also excellent, very reminiscent of Dylan’s Subterranean Homesick Blues but obviously far better. More power to Sally Hughes for Law and Liberty.

  14. Happy Day after Hate Crime Day. Aside from Sally and her letter and her visit to the cop shop to ask for clarification on a few points I see JK Rowling posted a series of tweets to test the water regarding the hate crime bill. I have no doubt they generated more than a few reports but Police Scotland have decided they are not criminal as they are not daft as taking on a test case against a lady with the resources of JK would be a fools errand. Not that has stopped them in the past. I must admit after her intervention during the Indyref I had no time for the lady but am warming to her for her efforts to protect women during these difficult times. There is a bit of a Joanna theme developing here as I see MP Cherry is also on the case which is good news. As the SNP seem determined to reduce the number of MPs they have at Westminster to under 20 in the spirit of Scotland United I will offer to help.

  15. Hate crime is again an orchestrated attempt to discredit Scottish Law by those that should protecting it . Hate crime is a tool for the colonial administration to suppress those who are seeking independence without the consequence and fall back on Westminster Government. It wisnae us. it will be used to take out those who are active in pushing for independence. The Colonial administration are trying to make a mockery of running Scotland by intent on instruction from their London masters, the Ferrys are a prime example of this , their aim is to destroy the independence movement from within. The SNP are a Trojan horse in the independence movement , 10 years of nothing but lies, just one more push, one more mandate, while deliberately frustrating the Scottish electorate at every turn. Nothing as it seems in UK,Ok. Infultration is the oldest game in the colonial masters handbook of divide and rule. They now wish to paint a picture that we are incapable of running our own affairs. All theatre for those who still think this is a democracy when it is clearly a colony of neighbour.

    1. I tried to sign the petition, filled in the boxes until it came to entering “Country”. I searched in vain for Scotland but the only option provided that I had to enter was “United Kingdom”,. 

      Sorry to say that no matter how strongly I support the petition it was left uncompleted.

And this is exactly why we are still in this accursed union SOA, when a politician who is a supposed independence supporter and a representative of a supposed independence party arranges a petition where the choice of country lists united kingdom as a restrictive choice for signatories in Scotland, does said politician or political party NOT realise that the united kingdom is NOT a country , it is a construct of various countries and is insulting to the indigenous peoples of those countries

        These ongoing mistakes??? makes me even more reluctant to believe that these people are seriously committed to independence irrespective of what it will take , these politicians are using the terminology used and favoured by unionists across the board to undermine and ridicule our fight for independence , Ash Regan actually VOTED FOR the reviled HCB so where now is her credibility in trying to get it repealed, IMO this is just a publicity stunt to excuse her lack of thought in interpreting the threat this reviled bill brought to her sisters AND freedom of speech

        What makes it even more disturbing is when people who were eager to sign the petition realise that the option of country is restricted to the uk and won’t now sign it , obviously that will affect the numbers willing to sign which will give humza and the other unionists who voted FOR the bill immense satisfaction

      2. What I could not understand was why they thought this would be acceptable. To send to people committed to ending the union is a massive error. Does no-one check this stuff before it’s published? 

        As you mentioned, I wonder how many others will refuse to sign even though they want the HCA repealed?

      3. The dropdown list of countries seems to be some kind of international default arrangement. An Irish book seller did their best for me to avoid “United Kingdom” in my address but after investigation apologised that the physical system just wouldn’t allow it. Ash Regan’s petition site I note is designed by NationBuilder. I doubt the site had any way out. Having said that I now remember that the Scottish Parliament site was (I haven’t been there recently) using a drop down country list including ‘Scotland UK’, ‘Wales UK’, ‘England UK’ as options. Something like that. Still no escape from ‘United Kingdom’ designation though. Any readers who are conversant with all of this please advise.

        As for Ash’s original vote for the Hate Crime Bill, her letter to Alba supporters yesterday explains her reasoning and regrets:

        A chilling effect occurs when the fear of police action stops a person from freely expressing a view.

        It’s “cancel culture” before you even dare speak or write.

        We are witnessing comedians, social commentators, and the public eviscerating the Hate Crime and Public Order (Scotland) Act across international, domestic and social media.

        During discussions on the bill with Humza Yousaf I raised two core concerns: protection of vocal disagreement without fear of recrimination, and misogyny.

        Colleagues assured me that the law would have clarity of intent built into the accompanying guidance, setting the bar for investigation and prosecution clearly above legally protected freedom of expression.

        I was asked for my view on whether we should include sex as a characteristic, to protect women from misogyny, and I said yes. I was told that in feedback from women’s rights organisations, they sought a separate offence in misogyny legislation that could assist in dealing with the specific considerations in domestic abuse law.

        After the act was passed, the follow-up meeting to discuss the guidance was a singular event that shaped my future political career. At that meeting ministers decided that they would not add clarifying real-world scenarios involving gender-critical feminists as there was nothing to gain, and it would upset the transgender lobby.

        Upon my return to Holyrood, after my re-election to the Scottish parliament in May 2021, the guidance still needed to be created.

        From speaking widely to women’s groups who had made significant contributions to our committee, I knew that my government had broken promises to consult them regarding clear guidance and additional protections for women in the proposed Misogyny Bill.

        Indeed, many had also wanted sex to be included in this bill, as I had first assumed, but my boss at the time had convinced me that my view wasn’t representative. The whole situation seemed bizarre.

        As I tried to make sense of it, I questioned whether this was incompetence in the legislative process or whether my party leadership had deliberately misled me and others to enable the bill to pass through parliament seamlessly.

        In 2021 the bill promised a pathway to additional protections to make our open and welcoming Scotland safer for all.

        The reality, three years on, is that Scotland, our police and parliament have been embarrassed, left to traverse a self-destructive pathway. The root cause of this, and other legislative failures, is the erosion of good governance to safeguard our legislative processes.

        I must now side with those who call for repeal. The chilling effect has begun, and the original vision of the bill is lost.

      4. Let us not fail to recognise a genuine explanation from Ash Regan and her published acceptance she was misled and now recognises she made a mistake. All we need now is for the majority of MSP’s who voted for the HCA to do the same.

  17. It is time to stop wheesht for indy – if there was a literate soul left in Scotland that had any faith in the competence, good intention or even sanity of this SNP crew then they ken noo as they say.

    This entitled collection of parasitic time wasters have dropped every ball of importance to the everyday folk in favour of their own wee bubble identity politics – and we the tax payer are paying for this – this sitting intently over a subsidised latte and debating the failed extremism of the far left that wishes to rule over the sweaties as whim, ego and arrogance dictate.

    Apparently a lot of complaints have been submitted over Useless and his ‘wite’ rant in 2020. Sadly the polis say this law is not retrospective – seems worth asking them if he would be considered to have broken it if it WAS retrospective.

    Jonathan Pie has a nice wee number on this. The wording of this law actually violates this law .. how dumb can you get? Pretty dumb it seems. Fortunately for Jonathan Pie Highland Grannies, being wimmin, are not protected by this law – and of course he is safe in the south …

  18. Utterly incredible that in 24 hours something between 3,000 and 4,000 reports to Police Scotland.

    Seems that many of the reports relate to the First Minister of the white, white, white rant. Police are apparently setting up a gold team of senior officers to assist investigating and processing. The insanity has just begun.

    Truly this insanity will in all possibility collapse the SNP but potentially the Scottish Parliament too. The Parliament and the county’s Police Force are at risk of being exposed as laughing stocks internationally as well as at home. Maybe the UK government will have to intervene. Scots got the rope and now they are going to hang from it.

    Internationally the Hate Crime legislation is attracting interest. It has widely been reported on TV and in the press across the USA. The politico Steve Bannon and Elon Musk have commented too.

    The Donkey Parliament is already getting the hits but is it the right type of hits. And this is only the start.

    And lastly, You Gov poll released today is predicting that at the UK GE the SNP will be reduced to 19 seats. As they say, that’s all for now folks.
