Commenting on the revelations contained in the Salvo paper Iain Lawson speaking on behalf of the Liberation Movement and as Chair of the Scottish National Congress Steering Group said “these discoveries are hugely important and will have a big impact on the fight for Independence going forward.


As Scots face a winter with many having to choose between eating or heating, the realisation that London has been involved in long term fraud and deception that has allowed them to steal hundreds of billions of pounds in assets (natural resources), from the rightful owners, the Scottish people, will cause great anger in Scotland.


How appropriate that in the same week that England’s Supreme Court announced that Scotland is not a colony, while at the same time ruling we had no rights to vote on our own Constitutional future without London’s permission, we are revealing today the fraud these colonial masters have been inflicting on Scotland for decades. A fraud that explains why Scotland remains poor despite discovering vast oil and natural gas wealth. We are once again witnessing the same rip off of our assets in terms of renewables as happened with our vast oil wealth.”


Concluding Mr Lawson said “ We hope the Scottish Government, armed with the proof of this extensive fraud will act and join with the Liberation Movement to challenge this fraud in the International Court. But in any event, the first job of the Scottish National Congress, now nearing its formal launch, will be preparing the case to take it to the International Court. We will seek a ruling, that this colonial style appropriation of the assets of the sovereign territory of Scotland is fraudulent and clearly illegal, and a remedy in terms of a legal requirements in line with international law for compensation.


Once the Scottish Liberation Movement reaches a substantial membership, around 100 thousand, and achieves recognition by the UN, we shall do what the Scottish Government cannot do, as a legislative arm of Westminster Government in Scotland. We shall seek proper remedy directly in the International Court to end this injustice and theft of our national resources.

If Scots want to end these flagrant injustices they need to join Liberation.Scot to enable our application for formal recognition as the legitimate Liberation Movement in Scotland to be approved as quickly as possible.


The People’s voice must be heard and recognised. Scotland’s People are sovereign and it is time for that sovereignty to be upheld.

We therefore call on our fellow Scots and the international community to support the campaign of the Scottish Liberation Movement to restore the rights of the sovereign territorial nation of Scotland under international law, to remove the ‘administrative’ control of the British state from the assets owned by the Scottish people and to obtain for this nation the restitution owed to them by the British state for its fraudulent appropriation of Scotland’s natural resources over many decades and of the benefits that should have accrued to the Scottish people as the lawful and exclusive owners of these resources.


NOTE
It should be noted that the earlier paper from Salvo highlighting the Claim of Right 1689 had a huge impact on the debate about Scotland’s future. The COR now forms a prominent role in the Independence debate, led to a Parliamentary debate on Independence and was responsible for the creation and growth of two new related Independence organisations both of which grow rapidly and already involve many thousands of members. Liberation targets 100,000 members which will enable recognition from the United Nations.

    1. Is it just me? I have tried the Liberation site, logging in unsuccessful so put in email for activation code. Message account does not exist with that email. so try to register, message account with that email already exists

      1. I’m having a great deal of difficulty even getting registered. I fill out the required information click on register and nothing ever happens. I’ve seen elsewhere others having the same problems, nae idea whit’s goin oan.

      2. I am going to ask the creator of the site to write an article going through the short history of the site to outline the story so far and what people can do to overcome any problems. A lot of these problems are historic when hackers were constantly attacking the site. Defences are much better now.

      3. Yes there is. The same thing happened to me, asked someone at the Alba conference to check it out for me and sure enough I WAS registered. I think the registration part of the webpage has been interfered with since the very beginning.

      4. Tried a month or so back to register with Liberation. Input name, password, email and it didn’t register me.

        Just a few minutes ago to register again. Input name, email, new password, catptcha, and message came back email and name exist. So went to forgot password put in email, catcha etc and entered and this time it comes back that account exists.

        Either whoever set up Liberation join website is a fifth columnist or someone or some-body is sabotaging and interfering with folks trying to register. My own suspicion is that the deep state or agents of the deep state are taking down registrations.

        Maybe Iain could enquire of the organiser of the website and report back on this platform.

      5. I had the same problem * guys * . It’s possible you are making the same mistake I did ..ie thinking L.Scot is a site like other sites where you can enter and exit at will . It’s not , it’s a * use once * only thing . Iain put me in touch with Ivan who oversees the registration process who explained this to me . It’s likely – as in my own case – that you ARE registered . I was mightily relieved when Ivan sent me a screenshot of the registered and my name was there . We really need to hit that target ; for the purpose intended , but also as a symbolic manifestation of our awareness of the broader , historical context of our situation and our intention not – NEVER – to be fobbed-off with Unionist legalistic legerdemain . Or , for that matter , Sturgeon/SNP S30 * Gold Standard * feeble-minded idiocy / self-serving procrastination

There is a very big Liberation website in the process of being built, Liberation is only months old and thousands have already signed up and we will get a lot more after today. It has also been under hacker attack so the main IT development has been controlling that. You will see the real and permanent site soon.

        The present CAN’T be understood without awareness of how it’s impacted by the past ; how the past still affects the present . From a certain perspective time – at least the notion that time is linear – is an illusion ( see Quantum Physics ) , everything that HAS happened , IS happening and WILL happen forms part of the Spacetime Continuum – the Eternal Present , if you want to call it that .

  3. In my opinion, you need to start working WITH others, particularly political parties ie.our elected representatives, to get them on board. It feels like you are trying to work against or despite them rather than WITH them. In Scotland we all need to eat humble pie sometimes in order to work TOGETHER rather than trying to lead the way alone. Salvo added to the YES MPs and MSPs, added to the leaders of different Independence parties, added to all the individual bloggers, added to the YES groups, added to SIC, Business for Scotland, added to all the other Yes people of our nation, this becomes a formidable force. This will require talks and persuasion. However, Salvo going alone with yours for Scotland blog alone is perhaps going to be an uphill struggle.

    1. Sheena, the SSRG and SALVO have tried, and tried damned hard. And a great deal of hate speech directed at ALBA and Alex Salmond in particular, seems grotesquely misplaced and defamatory. Salmond IS one of the good guys, with sincerity and Scottish Independence running through him like Brighton Rock. He is a Statesman, and one of the most powerful weapons in our arsenal, who poses a massive strategic and tactical threat to the Union.

      David Henry invited Alyn Smith to the SSRG Conference, fresh from Smith bumping his gums on stage about “unity”, only to be snubbed by Smith declaring “Never, not ever”. Where the hell does that hubris and petulant “attitude” come from?

      There is only one obnoxious and disingenuous “component” trying to go it alone and vilify the parts of the YES Movement who refuse to drink the SNP Koolaid.

      Funny how they start screaming about “unity” and togetherness whenever they’ve managed, “yet again” to squander the latest initiative and throw away stupid and dangerous concessions and capitulations.

      I’m sorry Sheena, maybe you’re sincere about unity, but there are a lot of people who see “unity” badly compromised by a “total liability”, and we know who we’re talking about… Don’t we?

    4. We are not alone, we are growing, if you check this morning a lot more blogs than just mine are carrying this news. Both Salvo and Liberation have many thousands of members. Salvo is around 8 months old Liberation about 3 months. Politicians are welcome to help that would be great but this might scare some because the structure is intended to stop any political control. It will be a true People’s Movement. We can do nothing yet about the MSM blanket censorship….but we do have a plan!

      It’s an absolute disgrace that they consistently ignore the great work done by many in Scotland and elsewhere in planning for a new country. Currency is the prime example.

      A colonial administration is never likely to support a national liberation movement. The primary role of a colonial administration is to prevent independence, much as we see in the ‘mystification’ policies and inactions of the SNP elite. Such is the Manichaeism nature of colonialism and especially in regard to the behaviour of a dominant national party in reaching a co-operation with the colonial power, rather than ending colonialism its role is now to extend it. This deceit is what gives rise to the shift away from a compromised and ineffective ‘independence movement’ which has been led up too many blind alleys, to development of a ‘national liberation movement’ more focused on delivering with greater urgency the core aim.

  4. I’m enjoying letting this sink in. It bears all the hallmarks of an endgame strategy that has been decades in the making. It’s been longer than that, I know, but its only been decades for me to witness first hand. This is the hornet’s nest that the UK’s Supreme Court was a little too casual in kicking over.

    Well, there it is Scotland.

    You want justice for MacRae? This is the way.
    You want justice for McCrone? This is the way.
    You want justice, and a future for your own wee “mac’s” and nighean’s? This is the way.

    I had a gran who used to wash her face in the morning dew of Spring, but never really told me why. And aye, you did get a wee dab aboot the chops too, whether you liked it or not, because that’s what grans do. I don’t know what belief it came from, but probably her gran doing the same.

    But after all these years, I think I get it. Because finally entering the endgame of Scottish Independence feels like washing your face in the first dew of Spring. The long winter is coming to it’s end.

    And how utterly refreshing it is to take in what is little more than an opening letter of intent , but still, not have the joy crushed out of you by some idiotic politician’s self interested caveats and sophistry. ‘It is in truth not for glory, nor riches, nor honours that we are fighting, but for freedom – for that alone, which no honest man gives up but with life itself.’

    My only observation is a lot of people report having bother signing up to Liberation.Scot. I think we need to go “nuclear” with getting signatures and sign-ups to the Liberation Movement. That means petitions on every street, a document to sign up to on every stall, climbing stairs and chappin’ doors.

    There’s a mood for it. Carpe Diem. An Aunt of mine was a civic minded sort of person, and often organised petitions for kid’s fitba pitches and stuff, and she knew all about twitching curtains when nobody came to the door. She looked like she was “fae the cooncil”. But when there was a petition circulating about the water privatisation, she said there were people hurdling the gate to get their name on the list. They were opening their doors and grabbing the pen before she’d even rang the doorbell. Even the wee neds she normally dreaded walking past wanted their names on the list.

    Granted, the Unionist’s aren’t going to sign, but I firmly believe Liberation.Scot would be as warmly received, and by a great many neutrals and undecideds too.

    And maybe too, if we’re quick about it, maybe a “Wee Blue Liberation book” to complete the set, and be spread far and wide doing justice to the Constitutional perspective and the Claim of Right. Afterall, a Sovereign people have the right to know they’re sovereign in a land where the Common Good held powerful sway in all things. A great, great many people still know nothing of this.

Totally agree with the gathering signatures at stalls, at doors etc. we have lots of yes groups feeling left out in the cold, this would the ideal job for them all, gathering signatures and email addresses. The emails could be typed in online by the groups and then verified by the individuals. The problems with the website seems to be commented on time and time again and yet it still appears to be a problem. Surely fixing this should be number one priority? To the salvo team, thanks for all you are doing.

      2. A new website is being constructed. A lot of the early problems have been ironed out. A lot of those problems were caused by serious hacker attacks. A very high level security expert handles the site.

  5. I just been talking to my wife and to be honest I probably should do it bit more often. I said to her, we’ve had all these rallies and what have we heard from the SNP leader, wait until next year, my wife’s reply was “it’s the weekend” you can’t argue with logic, no way am I telling her that.

    What so hard for Sturgeon to understand that the Gas and Oil along with all of Scotland assets are going to be essential to Scotland being a successful country which in return would benefit our people.

    I have no idea how this useless woman keeps getting away with let’s wait until the UKG does something before SNP or its leader does anything. The former FM has more options on the table than Nicola Sturgeon could take 12 months to dream about.

  7. The Politics of Scotland has changed little from a thousand years ago. The Political Party leaders are like the old Lairds and they expect their Clan to follow THEM. In the preparation to defend Scotland each looked to their own interest and the Clans interest first. An offer of titles and land in England tempted some. Some put one son on the Scottish side and one on the Englishside to ensure their land secured. Some taughtfor Scotland. On the Battlefield the Army had old festering sores between Clans making Unity difficult.. The factions of the Army often hated each other more than the English.

    We have elevated Political Party leaders to an undeserved status of Clan Chief who impose their viewpoint far more often than they listen to the Clan. The Clootie Clan are now the largest.

    Our common enemy used division as displayed throughout the building of the Empire.

    Yet even when our rag tag army took to the field it was often not Clan rivalry that lost the day it was dreadful leadership.

    Scottish Labour, Scottish Tories, Scottish LibDems ( the members not the leaders) are not the problem.
    Alba, SNP and ISP members have a great deal in common but the “Clan Chief” of the SNP has a bigger Clan and therefore in a repeat of ancient history she claims the right to lead the entire Army and dictate the tactics.

    So history will repeat itself and instead of a careful well planned Battle we will be told to charge downhill as a disorganised rabble. The captured Leader will then then swear fealty to her New Master.

    History is clear on it’s message. A Campaign led by ONE arrogant Clan Chief will end in disaster.
    However WITHOUT that large Clan we cannot win.

    The Sovereign People of Scotland need to put Scotland First instead of listening to those who view their own Clan as more important than the People of Scotland.

  8. Can I just echo Breek’s comment that we need to get out and canvass names. Collecting detail by internet is fine but the British state will and do attack web sites. Independence is their enemy, they are at war, and no one should be under any illusion as to what the British state and its mechanisms of state will do.

    And they will kill. SNP lawyers and independence fighter Willie MacRae is testimony to that.

    Or in Northen Irelands, the assassination of independence lawyers Rosemary Nelson and Pat Finnicane are other examples. Murders arranged by shadowy British army units like Force Research Unit, led by a Scot Brigadier Kerr, these units are very much active today in Scotland ready for physical deployment if needed.

    So, we must get out and canvas for support. A nation in a mass movement, spread across every corner of Scotland, cannot be defeated, will not be defeated.

    The Brits know this is endgame time. In 1997 some 74.3% voted for a Scottish Parliament. In 2014 some 45% of Scots against all the odds were reported as having voted for an independent Scottish parliament. Later some 62% of Scots voted to remain in Europe in a result diametrically opposed to England.

    The sentiment for independence is there and they know it. e will win but we need to get on and evangelise the mass into action.

  9. There are 2 aspects to this working together. It only gets trotted out by the SNP when they have made an a!?e of it! They have had 8 years to advance the cause and done nothing. The SNP see it all about getting them elected, keeping control and like the grand old Duke of York, marching us up the hill.
    There are options and the SNP know that however those options would further the cause of Independence far quicker so they are ignored. There have been papers prepared by the many groups supporting Independence that have provided solutions to the many issues raised during 2014, all have been ignored.
    Working together means accepting that no one party/group has all the answers. The SNP have, so far, shown little willingness to work with all YRS and Indy groups. Despite calling for it at Edinburgh demo this week, what do the SNP actually do? Call a party conference, NOT a convention of all. State that only SNP votes will count for the de facto election, if that ever comes about.
    Why are they not using the mandate they already have? Watch the arguements start within the rogue parliamentary groups. Each wanting the other to have the election, safeguarding their seats.
    Everyone else appears to be working together towards our Independence. Only the SNP are not and choosing to ignore all the work being done!

A small quibble with the introductory statemen which mentions the fraud perpetrated on Scotland ‘for decades’, I suggest this should be ‘for centuries’the theft of the land from the people of Scotland began in the 18th century after Culloden when the clan lands were siezed and given to supporters of the British Cause, mostly, but not all from England. The reparations for this wrong may well be crippling to their descendents!
    My other suggestion is that we should involve a widely respected Scottish historian to confirm the facts researched by Salvo, not that I think they are wrong, but to give them some validation in the eyes of the many who have not heard of Salvo and may not be willing to accept these findings, particulary as the effects of them are so serious to the establishment.
    Names that come to mind are Tom Devine and Murray Pittock, though I am wary of the formers’ acceptance of a knighthood from the British state, though I believe he supports Scottish independence. The latter used some of the researches of the Stennis Historical Society, in a book he was working on. That group was based at the Yes Hub and supported by that late Scottish Independence activist, Mike Blackshaw. The Stennis group members, of which I was one, undertook the transcribing of British army documents held in Edinburgh Castle, detailing the movements and actions of the British army after Culloden through a number of Cantonments throughout Scotland. These have been published , along with a map to demonstrate the extent of this, and distributed to many Schools across Scotland by Mike’s efforts and are an important contribution to the history of Scotland during that period,

  11. Has anyone actually read all of the “Reclaiming the Rights” paper? I tried but have to confess that after a while my eyes glazed over and it basically seemed to be the same thing that has been being discussed on this forum for the last few months. Nothing wrong with that, but I doubt if many members of the public will be bothered reading it.

    You will no doubt not be surprised to read that I’m not really very impressed by it. I could go over the arguments but I’ve done so in the past and am not going to do so again (sighs of relief all round). However, just as I have an opinion, so so those who believe in Salvo. There are a lot of good brains in that steering group, and I see Alf’s there too (sorry Alf, just joking, honest) and if nothing else I’m sure they’ll all soon be convinced that we are a colony and our people have a colonial mindset. So I suppose it’s possible that they may be right and I may be wrong. In any event, anything that may assist the move to Independence has to be welcomed and if this helps, good luck to you.

    Oh, and in case you’ve been worried, Iain, it’s been difficult, but I’ve managed to come to terms with the fact that I’m not going to get an invitation.

    1. Good luck indeed but that Claim of Right that the new English king recently swore to uphold was all about maintaining the Presbyterian Kirk from interference with its established privileges.
      In that respect it seems rather «retro». Scotland ought to look forward and free itself from the divisive elements in its history or is the doughty, covenanting lowland Scot the model for the future.
      It is not possible to undo the damage done by the séisms of 1560, 1603 and 1707, nevertheless that damage ought to contained within its historic context.
      Scottish independence does not need justifying text.
      The desire for freedom is ample justification.

        The Wright brothers came up with an idea to fly. They used wing warping as a flight control, they shifted their body to operate controls, they controlled pitch with a control wing at the front instead of aft in modern planes. To get to their target they also invented a lightweight engine and the wind tunnel. Not bad for the bike repairers.

        We could critique many of their plans, NOW, but the plane got of the ground and it was the start of a new age.

        Any idea or invention does not need to be perfect to bring in major change. Would you ignore the abacus and then the slide rule because someone may come along and invent an electronic calculator? Why travel by sail to discover other Worlds when you could wait for steam.

        Every time Edison tried a new technique for a light bulb his approach was to see it as an elimination of a way that didn’t work making success more likely.

        Throwing rocks is easy! I would rather be part of an attempt. You should try it.

      2. Yes, and Icarus flew too near to the sun and crashed into sea and drowned. Mythical perhaps, but many hopeful aeronauts died before the Wrights found a more reliable way and powered flight was achieved. So if Salvo think that their way will indeed assist the cause of independence, good luck to them. Personally I think it’s a waste of effort – I believe that there are much more effective ways of achieving independence and I’ll hopefully make some contribution to them

  12. Like the mood music , but in practical terms how would such a case make it to ICJJ? Both parties to the action would need to be states and members of the UN. We need to hear opinion from jurists such as E Kennedy on the matter of legal standing .

    1. If that is indeed the case I’m sure we could then find a friendly state which would act on our behalf – Ireland maybe? We’d probably be spoiled for choice – I suspect quite a lot of countries would like to give the UK a good slap.

      1. Daveytree 19…. That may be true , another state might conceivably raise an action on Scotland’s behalf. .The ICJ relies on legal reasoning established in preceding cases ..Are there any convincing examples of such causes ?

      2. Brian, I’m not by any means an expert on international law. What I can say is that the UN are usually very reluctant to interfere with the territorial integrity of another state. One example where they did was that of Kosova, where the UN decreed that Kosova’s secession for Serbia was right and proper, but in that case it was considered that Kosova was oppressed and, of course, I’m pretty sure there was some Western pressure as we busy bombing Serbia at the time. The comments of the British judge approvig Kosova’s secession are quite interesting.

        However, I doubt if they’ve ever before come againt a situation where an actual country that has been joined with another through treaty now wants to leave that union, where that country has retained its identity and borders, and where its people have made a democratic decision to that effect only to have that decision ignored by the bigger partner. Although the UN doesn’t consider Scotland (or England, for that matter) to be a nation state as such, it does recognise Scotland as a country. I doubt very much if there ever has been a precedent for a case such as this but the circumstances are such, and world-wide liking of Scotland so considerable, that I think it would be well worth a shot.

    2. That is not so Liberation movements of standing can also raise actions. This is necessary, just look at the UK. IT IS THE STATE. it will never raise an action against itself the Liberation movements of a sovereign country or people can get the legal status required. That is what we are targeting.

      1. Theoretically I think Scottish ministers could take the case to the ICJ. (they won’t but they could) Being devolved from WM they are “ministers of the crown” , and as such might well have sufficient “standing” to do so. Likewise the SNP itself, with 100,000 members, could declare itself to be a liberation movement of standing by dint of its huge membership , and take the case to the ICJ.

      2. I would be really worried if the SNP were to represent Scotland in any court ever again, also I think they would struggle to provide evidence of anything like 100 k members.

      3. I’ve had a good look through the Hague legal materials and the rules governing access to the ICJ. Only member states of the UN have locus standi (qualify ) to bring an action . Both parties ( the disputants) must consent to enter such legal arbitration and be bound by the decisions of the court . I’m no expert , but I see no mention of “liberation movements of standing ” . I’d be more than happy to be proved wrong. .

      4. Like Brian, I find nothing to say that Liberation movements can start actions. But it does seem that the rule that both parties must consent to an acrion can be circumvented, though in that case any decision reached will be non-binding, but will of course affect the reputation and standing of the state that does not comply. The recent case involving the Chagos Islands is such an example. Mauritius, with the support of some African states and the Chagos islanders themselves, brought an action to have the Chagos Islands, a British colony, returned to Mauritius. The UK, supported by the USA which has leased a military base there, applied to have the motion rejected before it began, but was heavily outvoted by the UN. The action proceeded, the court found in favour of the Chagos islanders, and the UK refused to accept the result. The matter then went to the general Assembly of the UN which again supported the courts verdict that the Chagos Islands shpould be returned to Mauritius. It is perhaps significant that only five other countries supported the UK, while 116 voted against and 56 abstained. The five countries that supported the UK were the US, Hungary, Israel, Australia and the Maldives. Clearly the UK does not carry much weight in the UN these days – indeed, I would suggest that there is considerable hostillty towards it.

        The problem with the Chagos Islands action insofar as Scotland is concerned is that the UN considered the Islands to be a colony, and they may well therefore have fallen within the decolonisation programme, which wuld not apply in Scotland’s case, and of course that the decision was non binding. But it does seem to show that an action can be brought even if one of the parties does not consent. And I’m pretty sure that when the ICJ considered the question ““Is the unilateral declaration of independence by the Provisional Institutions of Self-Government of Kosovo in accordance with international law ?” Serbia did not consent to the action being brought.

Even street stalls in every city with a petition prehaps would bypass the hackers from Brigade 77, and get the 100,000 signatures require for the UN Decolonisation.

  13. It seems like a large number of people are failing to, or think they have failed to register at liberation.scot.

    I hear that many have in fact registered but they don’t know.

    Is there a way of checking if a registartion has been successful?

    1. If you got an email today then you are certainly registered. A lot of these problems are historic and our site is constantly under attack. It has moved to a new location where very severe penalties are available for any hacker caught in the act.

  14. There is a mind set here that does not quite get it , when treaty’s where signed religion played a big part in there construction . Do not apply modern thinking to historical documents. Under international law it does not make these documents less lawful or less valid. Divide and rule has always been the British mantra for keeping the colonial peoples disunited. Catholic against Protestants, East against West and North against South and so on. If the claim of right was not valid do you really think Charles would have sworn a to uphold it. The claim of right and constitution are is valid today as 1707.
    Dissolve the Union.

  15. When visiting the Salvo site, there is a blue band along the top and the first heading is ‘Claim of Right’ (note no “The” on the blue, nor on document URL). The short article includes the passage:

    “The Claim of Right Act, passed in 1689 to depose James VII and II, affirms the existence of an enforceable, Scottish constitutional arrangement where the sovereignty of the people limits the power of government. And this constitution is still the Scottish constitution and still in force, in principle if not in fact, today.”

    So the concern of Salvo is to demonstrate firstly what the historical Scottish constitution was and secondly that it is still legally “live”, even if almost entirely ignored and suppressed. Charles’s reluctant spiel on taking up his post gave us a glimpse that something indeed is still legally, constitutionally, and unsuppressably live. So is there more?

    Charles is constitutionally required, as was Elizabeth before him, to swear ANNUALLY to uphold Presbyterianism in Scotland. But Salvo’s argument is that the there are OTHER constitutionally live aspects of the 1707 Union settlement which have been suppressed by the Union parliament. So under the heading ‘Resources’ — on the blue band — there is a second ‘The Claim of Right’ article (note this time ‘The’ on both title and article URL), and it is the following point 4b which gets emphasis more than 4a:

    “4. What Makes It All Possible
    “The Claim of Right Act, passed in 1689 to depose James VII and II, affirms the existence of an enforceable, Scottish constitutional arrangement where the sovereignty of the people limits the power of government. It comprises two distinct elements:

    “a. the action or effect of the statute in: deposing and replacing James VII and II, ensuring the continuation of a protestant monarchy, assuring the power of the Presbyterian Church in Scotland and excluding Catholics from any position of influence in Scottish society.

    “b. the constitutional grounds on which this was legally justified.

    “Action and effect have been overtaken by time and social change. The legal grounds on which the Act was passed, the limitation of governmental power and the right of the nation to enforce those limits, (popular sovereignty), are still in force.”

    However, let us not be too disparagingly hasty to dismiss some richly positive implications to the “Presbyterianism” issue. According to the English constitution Charles is, as was Elizabeth, the Supreme Head of the Church of ENGLAND (and all incumbents in the C of E must swear allegiance to him). There is a residual noxious whiff here of mystical “Divine Right of Kings” despotism. And of course full-on Catholicism had and has its own human absolute ruler.

    In what is quite stunning contrast, on the Royal dot UK site there is still (under ‘History’) the following paragraph (the site is being updated, but they haven’t got to this yet):

    “The Church of SCOTLAND is a Presbyterian church and recognises only Jesus Christ as ‘King and Head of the Church’. The Queen therefore does not hold the title ‘Supreme Governor’ of the Church of Scotland; when attending Church services in Scotland Her Majesty does so AS AN ORDINARY MEMBER.” (my emphasis).

    Obviously (though those of an orange hue would surely disagree) there is a refreshing lung-full of incipient REPUBLICANISM in this latter quote arising from our oxygen-rich living Scottish constitution.

    (As disclaimer let me say here that I hold firmly to the Church/ State division — though that should not mean that only humanist politicians have carte blanche to argue on the basis of their faith.)

The ‘religious’ is ‘political’ precisely because in defining the terms of the Church settlement in a territory you define the source and extent of power of the State.19 So in Scotland at least, the term ‘Papist’ translates into a believer in absolutist government; ‘Episcopalian’ into a supporter of constitutionally limited Monarchy; while ‘Presbyterians’ hold to a democratic model in which the Elect(ors) delegate defined and limited powers to those whom they appoint to hold office. »

  17. I have just noticed that at the bottom of the above-linked Aidan O’Neill submission page I had posted (yet again!) Professor Alexander Broadie’s YouTube audio on the Declaration of Arbroath. It occurred to me on reading last midnight’s Salvo document RECLAIMING THE RIGHTS OF SCOTLAND’S PEOPLE — about the stealing of our entire territory — that in Broadie’s audio that is PRECISELY the accusation that John Duns SCOTUS, the intellect behind the Declaration, lays against Edward 1, ie that Edward was such a big thief he had stolen a complete COUNTRY – Edward had STOLEN SCOTLAND, and what’s more he could not be forgiven until he repented…
